The Room of committal for trial refused this application, without answering for as much the argumentation.

On December 17, the call against this judgement goes to the Supreme court.

La plainte contre le général Franks n'est pas encore classée !
Le 23 septembre dernier, la Chambre de mise en accusation avait rejeté la demande de maître Jan Fermon de déclarer la nouvelle loi sur la compétence universelle (dite loi sur le génocide) inapplicable et de continuer les poursuites. L'argument clé avancé par maître Fermon est que la version amputée de la loi sur le génocide est en opposition avec le principe du "stand still": une fois que la législation belge a accordé des droits en application d'une convention internationale, elle ne peut revenir en arrière. C'est ce qui s'est passé suite aux pressions américaines. Suite aux modifications, les 19 plaignants n'ont plus le droit de poursuivre le général Franks.
La Chambre de mise en accusation a rejeté cette demande, sans répondre pour autant à l'argumentation.

Le 17 décembre, l'appel contre ce jugement passe devant la Cour de Cassation.

De klacht tegen generaal Franks is nog niet geklasseerd !
Op 23 september jongstleden heeft de Kamer van inbeschuldigingstelling de vraag van Meester Jan Fermon verworpen om de nieuwe wet op de Universele competentie (genocidewet) ontoepasbaar te verklaren en de vervolging tegen generaal Franks verder te zetten. Het centrale argument van Meester Fermon is dat de geamputeerde versie van de wet in tegenstrijd is met het principe van "stand still": eenmaal de Belgische wetgeving rechten heeft toegekend in toepassing van een internationale conventie kan ze niet meer terug achteruitkrabbelen. Dat is wat gebeurd is onder Amerikaanse druk met de genocidewet. De 19 aanklagers hebben niet meer het recht om generaal Franks te vervolgen.
De Kamer van Inbeschuldigingstelling heeft die vraag verworpen, zonder evenwel te antwoorden op de argumentatie.

Op 17 december wordt het beroep tegen deze uitspraak behandeld door het Hof van Cassatie.
