Geachte parlementsleden van Spa-Spirit,

UNICE, de unie van industrieën van de Europese gemeenschap, het "VBO" van de grote Europese ondernemingen, heeft onlangs haar analyse van het projekt van Europese Grondwet in het engels gepubliceerd (http://hussonet.free.fr/unicetce.pdf). Het is extreem leerrijk en stemt tot nadenken. Want het groot patronaat vergist zich zelden wanneer het erop aankomt te weten wat liberaal is en wat "sociale verplichtingen" zijn in een projekt. Wanneer ze ontgoocheld zijn, dan zeggen ze dat duidelijk (cfr. het persbericht van 11 mei : UNICE deplores European Parliament decision on working time directive; zie : http://www.unice.org/Content/Default.asp?)
Voor wat de Europese Grondwet betreft : het zijn echte fans van het projekt (pg.17: In general, UNICE welcomes the final document,(...)). U zal hieronder een bloemlezing van hun analyse vinden (tekst in het frans en het engels).

Het gezond verstand van de gemiddelde burger, werker, syndicalist leert ons dat wanneer het groot patronaat zich verheugt over een akkoord of wettekst, dat deze dan slecht is voor de mensen. Dit gezond verstand is dat van uw kiespubliek en kan u niet onbekend zijn. Tenzij u elk contact met uw basis verloren heeft. Hoe moet men anders verklaren dat u zich opmaakt een collaborationistische politiek te voeren met de grote Europese patroons. Dit projekt dat zij wensen gerealiseerd te zien, wel, daar gaat u als socialist of spiritist, meehelpen om het hen cadeau te doen ten koste van diegenen waarvan u beweert ze te vertegenwoordigen.

Ik hoop dat de lektuur van deze tekst u zal doen beseffen dat het spel van UNICE spelen gelijk staat met het verraden van de werkers, werklozen, kleine zelfstandigen,..., kortom uw kiezers.

Eerste reden van voldoening voor UNICE : de " competitiviteit " is alomtegenwoordig in de Grondwet.
" La nouvelle Constitution donne à la compétitivité une place réellement prééminente, parmi les objectifs de l’Union... C’est encore plus important quand on constate que beaucoup d’articles de la partie III de la nouvelle constitution font référence aux objectifs de l’Union. La notion de compétitivité est encore textuellement répétée dans beaucoup d’articles de la partie III : voyez par exemple l’article III-209 sur la politique sociale. "

A reference to a “highly competitive” European Union is incorporated in the first part of the Constitution among the objectives of the Union. This is a considerable change, as in the current Treaty of the European Union (TEU), competitiveness is not mentioned. It is only mentioned in the Treaty establishing the European Communities (TEC). Therefore, the new Constitution gives competitiveness a more prominent place. This is far more important, as many articles in Part III of the new Constitution (The Union policies) make a reference to the objectives of the Union. Competitiveness is additionally reiterated in many articles of Part III (e.g. art. III-209 on social policy)

Schitterende opmerking. Dit artikel stelt in wezen dat de sociale grondrechten van Europa rekening moeten houden met de noodzaak de competitiviteit te vrijwaren.

Tweede reden van voldoening : elke sociale harmonisering naar boven toe is afgewend.
" L’UNICE est satisfaite que le traité constitutionnel n’accroisse pas les compétences de l’Union européenne dans le domaine social, pas plus qu’il n’étende l’utilisation de la majorité qualifiée dans ce domaine. ".

UNICE is satisfied that the Constitutional Treaty neither increases competences of the EU in the social chapter of the Treaty nor extends the use of QMV.

UNICE heeft gelijk. En slaat de nagel op de kop : " L’unanimité reste requise pour toutes les mesures concernant la Sécurité sociale, la protection sociale des travailleurs, la représentation et la défense collective des intérêts des travailleurs, et les conditions d’emploi des ressortissants des pays tiers résidant légalement dans l’Union "

Unanimity is still required for measures concerning social security, the social protection of workers, the representation and collective defence of workers’ interests, and the conditions of employment of third-country nationals legally residing in the EU.

Derde reden van voldoening: de fiscale dumping kan gewoon doorgaan.

" L’UNICE est ravie (" pleased ") que les décisions du Conseil à la majorité qualifiée soient généralisées, sauf dans les cas prévus par la constitution, comme la fiscalité et les politiques sociales, où l’unanimité demeure. ".

UNICE is pleased that decisions of the Council by QMV are generalised, unless the Constitution provides otherwise, as is the case in the areas of taxation and social policy.

Vierde reden van voldoening: de Commissie en de Centrale Bank blijven buiten bereik.

" La rédaction de l’article sur la Commission s’inscrit dans la ligne des exigences de l’UNICE qui veut une Commission forte, gardant le droit exclusif d’initiative des lois. ".

The drafting of the article on the Commission is in line with UNICE’s demands for a strong Commission, keeping the exclusive right of initiative.
