Memorandum to the Prime Minister of Nepal

A known fact to the people of the world is that the political turmoil in Nepal is going on since 1996. From the very inception of the rebellion, the government of Nepal had to find a political solution of the crisis. Instead of that, it used weapons to clamp-down the demands of the people.

A known fact to the people of the world is that the political turmoil in Nepal is going on since 1996. From the very inception of the rebellion, the government of Nepal had to find a political solution of the crisis. Instead of that, it used weapons to clamp-down the demands of the people. The Nepalese government brutally massacred, suppressed the people's movements, flouted its own constitutional norms and values and nullified basic rights of people. A large number of Nepalese people including the leaders and the cadres of the Maoist and other Parties were arrested, tortured, disappeared and killed in different kind of operations the government launched it for several time. But government never ponder over the root of the problem, never attempted to find the political solution, and even never considered the 40 points demand that United People's Front, Nepal (UPF) presented before stepping up to the armed activities.

Instead of finding political solution itself, the government acted abrupt negatively against the prominent people of the country. Journalists, human right activists, lawyers, students, teachers, women, doctors,intellectuals, political parties and organisations, whoever seek political solution of the political crisis in the country were harassed, arrested, disappeared or killed by the government.

Ironically, instead of the government, the rebellion party CPN (Maoist) put forward political solution and asked for negotiation, but government could not play a positive role in this historical juncture. As the dialogue was going on government prepared ground for massive suppression of the people. Not only that, the government of Nepal suspended the fundamental rights of the people attained from the popular movement of 1990. It imposed a state of emergency, all kind of constitutional rights are suspended, and unleashed army.

The government have come up with the logic that the present upraising in Nepal is a terrorist movement. At the same time it is also making allegation that the Nepalese people under the leadership of the CPN Maoist are nullifying democracy, imposing communist dictatorship. But it is crystal clear to all, that the government carried out several assaults against the people while raised concern about nationality, democracy, and livelihood, before people took over the arms against government suppression,. The Congress government cruelly killed the then Central Committee member of the CPN(Maoist), Mr. Ram Brikshya Yadav in Dhanusha district in August,1995 (Vadra 2052). Hundreds of people were arrested, tortured, and disappeared under Romeo Operation on October /November, 1995 (Kartik 2052) .

It is obvious that the people had no other options other than rebel, when the government totally curtailed all basic rights of citizens introducing state terror. Under your very premiership, the United People's Front, Nepal under the leadership of Dr. Babu Ram Bhatarai, the political wings of CPN (Maoist) submitted 40-point demands on 3 February,1996 (Magh 21,2052), concerned with severe problems of nationality, democracy and livelihood and of the Nepalese people, and giving an ultimatum for armed struggle against white terror. But your government not only totally remained ignorant to the problem of the country and the people but also ignored the just demands of the people. Ultimately, the Nepalese people under the leadership of the CPN (Maoist) were bound to resort to the armed struggle since 13th February, 1996 (1 Falgun, 2052)

CPN (Maoist) had, time and again, put forward the political solution of the interpenetrating crisis of the country. Even than the government failed to show up political maturity and engaged into the power snatching game within parliamentary parties still forgetting to address the problems of the country and the people. King Birendra took liberal stand to the people. And he, reluctant to unleash army against the people and finding a political solution, were killed under a cool blood conspiracy with in the palace, eliminating century's monarchical system in Nepal. And Gynendra, a big comprador businessman and a notorious drug dealer, who put Dipendra the then crown prince and student of Eton College in the USA into drug addiction (which now proves that it was a part of conspiracy to finish Royal family), declared himself as a king of Nepal overnight. Again CPN (Maoist) put forward for dialogue and negotiation. But government totally ignored this and hatched another conspiracy to turnout the whole country to the blood pool, and started killing people all out open and indiscrimination. All other parliamentary political parties are against this emergency. Millions of Nepalese took over the street in Nepal supporting the demands of the Maoist and the party itself. Even in the military actions against RNA, carried out by the Maoist, thousands of people take participation, (anyone can see the report of the BBC correspondent Danial Lac), and twenty million people are against the feudal autocracy and for the people's republic of Nepal.

Now anyone can understand that who is terrorist! Can these twenty million people of Nepal be labelled as terrorist and this clique of drug dealer, comprador businessman, and the murderer of the Royal family be considered as democratic? Can the people who have been openly organising popular Siliguri meeting with all political parties, for the political solution, even under the difficult situation, be considered as undemocratic and who have been conspiring to cease power reckoned as democratic? Can the people who ask for referendum on monarchy be considered as dictator and those businessman who declared king himself overnight be consider a democratic? The Nepalese people, under the political line and leadership of the CPN Maoist is asking for political solution, and now the party is putting forward the demand of constituent assembly, interim government, and furthermore, a roundtable discussion among the political parties and organisation within and without of the parliament to find at least a minimum and minimum forward-going political solution. But your government, ignoring this all political issues, is engaged in buying sophisticated weapons from around the world. Now anyone can understand whether these twenty million people who seek these all political options are terrorist or the clique who is trafficking weapons against these twenty million people is terrorist!

The label put against Maoist and against the people as terrorist, undemocratic, dictator etc is absolutely baseless. Moreover your government is acting of these characteristics. This kind of ruler have no right to rule in any of the country in the world, that is proved in the history. And Nepal can not be exception of that.

Having killed popular journalist Krishna Sen, having disappeared Milan Nepali and other team of the journalists yet, having imprisoned and tortured or killed the popular leaders and cadre of the people, and killing dozens of unarmed people everyday, to lie the European leaders, that the Nepalese government is fighting for democracy is to dupe European people who have a strong solidarity with the Nepalese people. It is a social crime to attempt to close the eyes of the conscious people in the world. Unless you find a political solution and get into negotiation, your government can in no condition be justified that you have a public support in the country and in aboard among the Nepalese and other nationals of the world.

If you claim to be democratic, what prevents you to admit into the election of the constituent assembly, which give the people right to judge themselves to make their future? The people in the world over want to see the Nepalese government recognise the human right, follow the rule of law, establish democratic norms and conditions in the country, establish pro-people governance and respect the people of Nepal and of the world over.

Hence, we, the Nepalese who are forced to stay in abroad because of the white terror conducted by the government, strongly demand with you to terminate this violence, end of emergency, negotiate with CPN (Maoist), find forward going political solutions.
